"I. a writ, order or direction in the nature of Mandamus commanding/directing the respondents specially the respondent no.4 not to interfere in the peaceful possession of the petitioners over gata no.1091, rakba 2+20 i.e. 225 and gata no.1118 rakba 52+20 i.e. 375 Sq Gaz (Old numbers) (New number Gata No. 660, 661 and 662 rakba 0.4430 hect, 0.1390 hect, and 4430 hect) situated Village-Vanchawali, Tehsil-Sikandarbad, Bulandshahar which was allotted to the petitioners by the Land Management Committee, Vanchawali by way of residential lease date 23.09.1972, 07.12.1972 and 27.09.1978. It is contended that the petitioners were allotted land way back in the year 1978 and registered lease deed was executed. The Pradhan is trying to evict the petitioners from the land in dispute on the ground that the overhead water tank is being constructed. Petitioners claim that they have constructed a house after the land was allotted to them. They have moved an application dated 08.08.2023 before respondent no.2, which is pending
consideration. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- District Magistrate, Bulandshahr, District- Bulandshahr to decide the application dated 08.08.2023, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of
certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
