Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the parties and perused the record. 3. This writ petition has been filed seeking following relief :- "To direct the Civil Judge (Senior Division), Gorakhpur to decide the Misc. Civil Case No. 325 of 2022 (Santosh Kumar and others Vs. Bharat Pandey and another), for preparation of final decree on the basis of order dated 29.09.2022 passed in Original Suit No. 212 of 2019, within stipulated period." 4. Learned counsel for the petitioner submitted that the above-mentioned case is pending consideration since 2022, the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 5. Since the above-mentioned case is pending, no useful purpose would be served in keeping this petition pending. 6. In view of the above, this writ petition stands disposed of with a direction to the Civil Judge (Senior Division), Gorakhpur to decide the above- mentioned case, in accordance with law, expeditiously, preferably within one year from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties as well as giving a reasonable opportunity of leading evidence in respect of their case provided there is no other legal impediment.
