NO.101/1996 ON THE FILE OF THE CIVIL JUDGE (JR.DN) & JMFC., K.R.PET. THIS APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER Learned counsel for the appellant along with the appellant and learned counsel for the respondent along with the respondent are present. 2. They have agreed to settle the matter by dividing the suit schedule property into two halves i.e. 50% to each i.e., plaintiff and the defendant. It is 4 also agreed that the appellant/defendant has grown coconut trees; therefore, he is entitled to the extent of land where the coconut trees are grown large in numbers. Parties shall equally divide the suit schedule properties between themselves, even the land i.e., available and what is shown in the suit schedule property including that of the Karab land if any shall be divided equally by 50% for each of the parties. Both the parties submit that they have access to ingress and egress their land by way of road. 3. Learned counsel for both the parties shall produce a survey sketch by taking the assistance of a local land surveyor and divide the land, based on the agreement arrived today and place it for the division of the properties. 4. Appellant submit he had grown ginger in some portion of the land. Respondent has no objection to the appellant taking the crop that he has grown and having the portion of the land that is falling to the share of the respondent. 5. A Six month period is granted for the appellant to take the benefit of the crop. 5 6. In terms of the settlement, learned counsel for both the parties shall provide the sketch for drawing up the decree. The appeal is disposed of in terms of settlement. 7. Draw the decree accordingly.
