IN THE HIGH COURT OF ORISSA AT CUTTACK W.P. (C) No.29747 of 2025 Riyanka Jena …. Petitioner Mr. B.S. Panigrahi Advocate -Versus- The State of Odisha & others …. Opposite Parties Mr. P.K. Ray, AGA Mr. B.P.Rath, Advocate for O.P. CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.10.2025 01. 1. Heard Mr. Panigrahi, learned counsel for the petitioner and Mr. Rath, learned counsel appearing for the private opposite parties besides Mr. Ray, learned AGA for the State. 2. Instant writ petition is filed by the petitioner for a direction to the opposite parties and particularly, opposite party No.2 to conduct an enquiry into the allegations levelled against opposite party Nos. 7 to 10 considering the grievance petition dated 26th September, 2025 at Annexure-1 with regard to the disqualification of the latter before the no confidence motion is held on the date fixed for the reasons stated. 3. It is submitted by Mr. Panigrahi, learned counsel for the petitioner that the petitioner is the Sarpanch and he has approached opposite party No.2 with the grievance petition at Aneuxre-1 alleging disqualification of opposite party Nos. 7 to 10 but it has not been attended to and in the meantime, the vote of no confidence has been proposed and fixed to 6th November, 2025. The submission is that before any such motion is held, opposite party No. 2 should be directed to consider Annexure-1 as it is in relation to disqualification of the private opposite parties as the Ward Members of the GP. 4. Mr. Rath, learned counsel for opposite party Nos. 7 to 10 submits that the petitioner has approached this Court once again with such a grievance as per Annexure-1, whereas, he had filed W.P.(C) No. 26006 of 2025 pending disposal, wherein, there has been an order about the motion to be held but the result thereof to be subject to the outcome therein. Mr. Panigrahi, learned counsel for the petitioner submits that the motion has not been held on the date fixed and it was postponed to 6th November, 2025. Considering the submissions as above and since the petitioner claims the private opposite parties having invited disqualification and that such grievance is not yet considered, the Court is inclined to direct opposite party No.2 to take it up immediately and dispose of Annexure- 1, if possible, at any time before the date fixed for motion. 5. Accordingly, it is ordered. 6. In the result, the writ petition stands disposed of with the direction as aforesaid to be complied with by opposite party No.2 at the earliest disposing of Annexure-1 with a decision duly communicated to the petitioner immediately thereafter. 7. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge kabita Designation: Secretary
