Sri Rakesh Kumar Srivastava, Advocate appears and submits that the accused/applicant has been falsely implicated in Case Crime No.642 of 2024, under Section 2/3 Gangster Act, Police Station Sector-39 NOIDa, District Gautam Budh Nagar. 2. Learned counsel for the accused-applicant, contends that in gang-chart, five cases have been shown against the accused- applicant, in which he is on bail. Applicant is languishing in jail since 13.11.2024. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail, but conceded that in all the cases shown in the gang chart, the accused/applicant has already been granted bail. 4. This Court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records. 5. The record reveals that the forty three cases of criminal history has been explained in paragraph 3 of the supplementary affidavit, which prima facie, shows that all the cases are of Sections 379 and 427 IPC, wherein the FIR has been registered against anonymous persons. The applicant is in jail since November, 2024. 6. As such the bail application is allowed. 7. The accused/applicant- Deepak Alias Manish be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
