For Petitioners: Mr.G.Gautham Ram Vittal For Respondent: Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Crl.Side) ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondent to file an application under Section 7(10) of the Tamil Nadu Protection of Interests of Depositors (In Financial Establishments) Act, 1997 before the TNPID Court, Chennai, for ordering an interim distribution of the realised amount to the petitioners in connection with Crime No.12 of 2017. https://www.mhc.tn.gov.in/judis WP Crl. No. 1490 of 2025 __________ Page3 of 5 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The petitioners are the victims. There are totally 9927 victims and the total amount alleged to have been cheated is more than Rs.220 crores. Based on the complaints lodged by the victims, twelve FIRs were registered for the offences under Sections 406, 420 and 120B of IPC and Section 5 of the TNPID Act, 1997. Insofar ar the FIR in Crime No.12 of 2017 on the file of the Inspector of Police, EOW Headquarters, Chennai, is concerned, a final report has been filed against the accused and the same is pending for taking cognizance. Pending investigation, the petitioners submitted representations to disburse the amounts which were already seized from the accused. 4. There are totally twelve accused. So far, the Investigating Agency has recovered a sum of Rs.8 crores as liquid cash and the properties worth about Rs.15 crores were identified and also taking appropriate steps to attach the same. Whatever the amount recovered from the accused is now lying with the respondent herein. 5. In view of the above, the Competent Authority is directed to disburse the available amount to the victims proportionately, on verification of https://www.mhc.tn.gov.in/judis WP Crl. The respondent is directed to complete the said process within a period of twelve weeks from the date of receipt of a copy of this order. Further, the Investigating Officers and the respondent are directed to verify the balance sheet of the accused and take appropriate steps to recover the remaining amount in accordance with law. 6. With the above direction, this Writ Petition (Criminal) stands disposed of.
