Neutral Citation No. - 2025:AHC:132427 Court No. - 4 Case :- WRIT - A No. - 11212 of 2025 Petitioner :- Shweta Rai Respondent :- State Of Uttar Pradesh And 3 Others Counsel for Petitioner :- Abhishek Bhushan,Nikhil Anand Counsel for Respondent :- C.S.C.,Siddharth Singhal Hon'ble Ajit Kumar,J.
1. Heard Sri Abhishek Bhushan, learned counsel for the petitioner and Sri Siddharth Singhal, learned counsel for the respondent nos.2 and 3. 2. By means of this petition filed under Article 226 of Constitution of India, petitioner has sought writ of certiorari to quash the final result published by the U.P. Subordinate Services Selection Commission dated 02.07.2025 in respect of post of Mukhya Sevika. 3. It is argued on behalf of the petitioner that since the advertisement itself provided for amendment in application form by 31.08.2022 pursuant to the Advertisement No.2 of 2022 issued in respect of post in question the petitioner's EWS certificate obtained by him on 29.08.2022 ought to be considered to be valid one within the time limit prescribed in the advertisement. He has further argued that the petitioner was already having EWS certificate on 11.08.2021 for the financial year 2020-21 and therefore, in the next financial year he applied for another EWS certificate which got issued only on 29.08.2022 but in any case before the last date prescribed for amendment of the form in respect of Clause 8 of the Advertisement as 31.08.2022. 4. Per contra, Sri Siddharth Singhal, learned counsel for the respondent-Commission submits that the controversy is no more res integra as a Coordinate
Bench of this Court in the matter of Ranjana Rai v. State of U.P. and others in Special Appeal No.785 of 2022 decided on 13.12.2022 has already considered in extenso the impact of the amendment Clause to be read with Clause 8 of the Advertisement and finally concluded vide its judgment dated 11.11.2022 that the mandate contained in Clause 8 would be having binding effect and will not get influenced by the date prescribed for amendment in the application form. 5. It is contended that the said judgment has stood confirmed in appeal being Special Appeal No.785 of 2022 decided on 13.02.2022.
It is further contended that the relevant EWS certificate for the previous financial year for which it has been issued and in any case would loose its relevance and significance at the end of the financial year for which it is issued. It is thus contended that petitioner had neither the EWS certificate at the time of issuance of the advertisement, nor on the last date of the submission of the application form prescribed under the advertisement. 6. Upon a pointed query being made learned counsel for the petitioner could not cite any judgment contrary to the judgment cited by Sri Singhal,
learned counsel for the respondent-Commission.
7. In view of the above, I do not find any merit in the petition. Petition fails and is accordingly, dismissed.
