JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2025:KHC:35645 WP No. 24360 of 2025 ORAL ORDER The petitioners have filed their applications for issuance of passport, and it is undisputed that they stand trial in a criminal proceedings that are pending against them in Crime No.114/2019 with the Ramanagara Women Police Station. Significantly, the petitioners have called in question such proceedings before this Court in the writ petition in W.P. No. 25679/2022 and they have the benefit of interim order staying further investigation/proceedings. Sri Naveed Ahmed, the learned counsel for the petitioners, and Smt Reshma K T, the learned Central Government Counsel for the respondents, are heard. In terms of the Guidelines in No.G.S.R. 570(E) dated 25.08.1993, the respondent's consistent stand, as it should be, is that if criminal proceedings are pending, the request for issuance of passport or renewal thereof will be considered if the concerned Court permits travel abroad. Smt Reshma K T - 4 - HC-KAR NC: 2025:KHC:35645 WP No. 24360 of 2025 submits in line with this consistent stand that the petitioners can approach the second respondent [the Regional Passport Office] once they are permitted to travel abroad. This Court is of the view that there cannot be any interference in the present proceedings in view of the afore and that the petition must be disposed of subject to all just exceptions.
