Petitioners seek quashing of FIR No.66 dated 05.05.2022 under Sections 341, 323, 148, 149 Indian Penal Code, Police Station Sirhali, District Tarn Taran, Punjab and all consequential proceedings arising therefrom, on the basis of compromise dated 25.09.2025. 2. On 09.10.2025, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise. 3. In compliance of the aforesaid order, parties appeared before learned JMIC, Tarn Taran on 04.11.2025. Statement of Investigating Officer ASI Beer Singh was recorded on 19.11.2025. Learned JMIC, Tarn Taran has submitted her report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report SUMIT SINGLA 2026.07.27 16:32 I attest to the accuracy and integrity of this document CRM-M-56392-2025 (O&M) -2- as under has been submitted: “1) As per record and information provided by the Investigating Officer, there are eight accused persons namely Swaran Singh now (deceased) son of Jarnail Singh, Jasbir Singh son of Swaran Singh, Amritpal Singh son of Jasbir Singh, Ranjit Singh son of Swaran Singh, Waryam Singh son of Gurjit Singh, Joban singh son of Ranjit Singh, Balwinder Singh son of Milkha Singh, all residents of village Shakri and Yadwinder Singh son of Balwinder Singh, resident of of village Jivan Singh Nagar, Gali Kirpal Singh Wali, Tarn Taran, arrayed as accused in the present case. 2) As per record, there is only one complainant/victim namely Gurpal Singh who has been impleaded as a respondent no.2 in the present petition. 3) As per record, the present petition has been filed by all the seven accused persons namely Jasbir Singh son of Swaran Singh, Amritpal Singh son of Jasbir Singh, Ranjit Singh son of Swaran Singh, Waryam Singh son of Gurjit Singh, Joban Singh son of Ranjit Singh, Balwinder Singh son of Milkha Singh and Yadwinder Singh son of Balwinder Singh. There are total eight accused and one of them namely Swaran Singh has died. He is not a party in present quashing petition. 4) As per record, no affeceted person is left out to be arrayed in the quashing petition. 5) As per record and information provided by the SUMIT SINGLA 2026.07.27 16:32 I attest to the accuracy and integrity of this document CRM-M-56392-2025 (O&M) -3- Investigating Officer, none of the accused has been declared proclaimed offender. 6) As per statement of I.O. the stage of case is on investigation. 7) As per statements recorded by the parties, this Court is of considered opinion that compromise between the parties is voluntary and not result of any pressure or coercion etc, in any manner. 8) As per record and information provided by the Investigating Officer, accused persons are not involved in any other FIR/criminal case. 9) As per record and information provided by the Investigating Officer, there is only one complainant/victimnamely Gurpal Singh.” 4. Learned State counsel and learned counsel for respondent No.2 have not raised any dispute regarding the factum of compromise between petitioners and respondent no.2. 5. Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility. 6. Following principles of law laid down by the Full Bench Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303, the petition is allowed.
