The peoner incarcerated in the FIR caponed above, has come up before this Court by filing the present peon under Secon 439 Cr.P.C. 2. Custody cerficate dated 10.09.2025 of the peoner has been filed by the learned State counsel in Court today, which is taken on record. 3. A9er arguing for some me, counsel for the peoner wishes to withdraw the present peon with liberty to file a fresh a9er compleng custody of one year and 06 months in this FIR. 4. Given above, the present peon is disposed of as withdrawn with liberty as prayed for. It is clarified that there shall be no need to file fresh power of a;orney in the fresh peon and power of a;orney filed in the present case shall suffice, Registry shall not raise any objecon. However, it is further clarified that the me for which the trial is delayed at the peoner’s instance, said period shall not be counted in the period for which the liberty is granted.
