JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the petitioner –accused No.5 under Section 483 of BNSS praying to grant bail in Crime No.203/2025 of Chandralayaout Police Station Bangalore registered for offences punishable under Sections 103(1), 189(2), 191(2), 115(2), 352, 109, 190 of BNS. 2. Heard learned counsel for the petitioner and learned Additional SPP for the respondent –State. 3. Learned counsel for the petitioner would contend that no serious overtact is alleged against the petitioner. The allegation made against the petitioner is that he assaulted C.W.4 with hands. The petitioner is in judicial custody since 20.06.2025. He further submits that as the charge sheet is filed, he is not required for any custodial interrogation. Accused No.6 who is similarly placed to that of this petitioner has been granted bail by - 3 - HC-KAR NC: 2025:KHC:52564 CRL.P No. 15315 of 2025 this court in Crl.P.No.11490/2025 by order dated 10.10.2025. With these, he prays to allow the petition. 4. Per contra, learned Additional SPP for the respondent –State would contend that the petitioner is part of unlawful assembly and he had common object along with other accused persons. The petitioner has assaulted C.W.4 with hands. There is prima face case against petitioner for offences alleged against him. With these, she prays for dismissal of the petition. 5. Having heard learned counsels, this Court has perused FIR, complaint, charge sheet and other materials placed on record. 6. Cl.No.17 of the charge sheet indicates that there is quarrel between accused No.1, the deceased and C.W.2 to C.W.4. Accused No.1 has secured accused Nos.2 to 6. Accused Nos.1 to 6 have formed an unlawful assembly and assaulted the deceased. The petitioner - accused No.5 has assaulted C.W.4 with hands. There is no allegation of petitioner assaulting the deceased. The post - 4 - HC-KAR NC: 2025:KHC:52564 CRL.P No. 15315 of 2025 mortem report indicates that the cause of death is due to injury sustained. Accused No.6 who is similarly placed to that of this petitioner has been granted bail by this Court. Considering the said aspect, the petitioner has made out case for grant of bail with conditions. 7. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No.203/2025 of Chandralayout Police Station, Bengaluru subject to following conditions. a) The petitioner –accused No.5 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of jurisdictional Court. b) The petitioner –accused No.5 shall not tamper the prosecution witnesses directly or indirectly. c) The petitioner –accused No.5 shall appear before the trial Court on all dates of hearing - 5 - HC-KAR NC: 2025:KHC:52564 CRL.P No. 15315 of 2025 unless exempted and co-operate for speedy disposal of the case.
