The present appeal is directed against impugned judgment of conviction and order of sentence dated 29.05.2008 passed by the Sessions Judge, Durg (C.G.) in Sessions Trial No.181/2007, whereby and whereunder, the appellant stands convicted under Sections 450, 376 (1) of IPC & sentenced him to undergo R.I. for 03 years with fine of Rs.500/- and R.I. for 07 years with fine of Digitally signed by VIJAY BHARATRAO PEKDE 2 Rs.1000/-, plus default stipulation. 2. Non-bailable warrant issued against the appellant has been returned unserved with a report dated 09.06.2025 of S.H.O., P.S.- Mohan Nagar, District Durg that the sole appellant died on 25.08.2022 in a train accident. The report of S.H.O., Mohan Nagar, Durg is duly supported by the merg intimation, identification panchanama and inquest memo of the deceased appellant. 3. Learned State counsel has gone through the report of S.H.O., P.S. Mohan Nagar, Durg and confirmed the death of sole appellant on 25.08.2022. 4. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record, the appeal abates and the same is dismissed as abated. 5.
