ORAL ORDER In this petition, petitioners have sought for the following reliefs:
1. Issue an appropriate writ or order or direction, quashing the FIR registered in Crime No.0342/2024 dated 24.05.2024 Vide Annx A and B of Hebbagodi Police Station in respect of the petitioners arraigned as Accused No.'s 1 to 4 respectively for the offences punishable under sections 498A, 504, 506, 307, 323 and 324 of IPC, 1860 along with sections 3 and 4 of

Dowry Prohibition Act, 1961; pending before the Addl Civil Judge (Jr.Dn) & JMFC Court, Anekal, Bangalore Rural District; arraigning the petitioners herein as accused respectively. 2. Grant such other reliefs as this Hon'ble Court deem fit in the facts and circumstances of the case, in the interest of justice and equity.”
2. Heard learned counsel for the petitioners and learned Addl.SPP for 1st respondent as well as learned counsel for 2nd respondent and perused the material on record. 3. A perusal of the material on record will indicate that respondent No.2-complainant filed a complaint before respondent No.1 police in Crime No.342/2024 for offences punishable under Sections 498-A, 504, 506, 307, 323 and 324 of IPC and Sections 3 and 4 of the D.P.Act. Further, the matrimonial dispute filed by the 1st petitioner-husband against the 2nd respondent - wife in M.C.No.6762/2024, ended up in settlement, wherein both parties settled the matrimonial dispute with mutual consent and further agreed to co-operate for quashing of proceedings in Crime No.342/2024 pending before the Trial Court. The relevant portion of the said Memorandum of Settlement dated 05.06.2025 filed before the Family Court reads as under:

8. In view of this settlement the respondent has agreed to co-operate in closing / quashing the proceedings in Crime No. 342/2024 filed at Hebbagodi Police Station filed against the petitioner and other family members for the offence punishable under Section 498-A, 504,506, 323 & 324 of IPC and 3 & 4 of D.P.Act pending on the file of the Addl. Civil Judge (Jr.Dn) & JMFC Court, Anekal, Bengaluru Rural District. 9. The petitioner and his family members have filed W.P.No.14051/2024 (GM-RES) before the Hon'ble High Court of Karnataka, Bengaluru for quashing the proceedings in Crime No.342/2024.
In view of this settlement the respondent has agreed to co-operate with the petitioner and his family members for closing the W.P.No.14051/2024. 4. In view of the aforesaid facts and circumstances and the fact that the 1st petitioner-accused No.1 and respondent No.2- complainant have settled the matrimonial dispute and also agreed to co-operate for quashing the proceedings in Crime No.342/2024 pending before the Trial Court, continuation of criminal proceedings against the petitioners would amount to an abuse of process of law and the same deserves to be quashed. - 5 -

5. In the result, I pass the following:
ORDER (i) Petition is hereby allowed. (ii) Further proceedings in Crime No.342/2024 registered by the 1st respondent – Police for offences punishable under Sections 498-A, 504, 506, 307, 323 and 324 of IPC and Sections 3 and 4 of the D.P.Act, pending on the file of Addl.Civil Judge (Jr.Dn) & JMFC, Anekal, Bangalore Rural District, Bangalore, insofar as the petitioners are concerned, are hereby quashed.
