JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 (as per FIR) under Section 483 of BNSS praying to grant bail in Cr.No.73/2025 of Virajpet Town Police Station registered for offences under Section 109(1), 115(2), 310(2) and 190 of BNS. 2. Heard learned counsel for petitioner and learned HCGP for respondent/State. 3. Learned Counsel for petitioner would contend that accused No.2 – Pavan has been granted bail by this Court by order dated 17.11.2025 passed in Crl.P.No.13854/2025. The petitioner is a student studying in BCA. The alleged incident has taken place in a sudden quarrel. The petitioner and the injured persons are friends. The petitioner is aged 20 years and he is having no - 3 - HC-KAR NC: 2025:KHC:49520 CRL.P No. 14740 of 2025 criminal antecedents. The injured have been discharged from the hospital and they are out of danger. The petitioner is ready to co-operate for further investigation and abide by any conditions to be imposed by this Court. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that serious overt acts are alleged against this petitioner assaulting the injured with knife and causing grievous injuries. The injured have sustained grievous injuries on their vital part. The investigation is in progress. With this, she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the FIR, complaint, remand application and other materials placed on record. 6. Petitioner is arrayed as accused No.1 in the FIR and as accused No.3 in the remand application. The overt act alleged against this petitioner is assaulting complainant, Karthik and Darshan. The incident took place - 4 - HC-KAR NC: 2025:KHC:49520 CRL.P No. 14740 of 2025 in respect of girl by name Pooja. The injured who sustained grievous injuries have been discharged from the hospital and they are out of danger. The petitioner is in custody since 11.09.2025 and therefore, he is not required for any custodial interrogation. There are no criminal antecedents of the petitioner. The petitioner is a student of BCA. Accused No.2 – Pavan has been granted bail by this Court. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. The petitioner is granted bail in Crime No.73/2025 of Virajpet Town Police Station subject to following conditions: 1. The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the likesum to the satisfaction of the jurisdictional Court. - 5 - HC-KAR NC: 2025:KHC:49520 CRL.P No. 14740 of 2025 2. The petitioner shall not tamper the prosecution witnesses either directly or indirectly. 3. The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case. 4. The petitioner shall co-operate with I.O. for further investigation. 5. The petitioner shall not commit any offence. If the petitioner is found having committed any offence, the prosecution is at liberty to seek cancellation of the bail granted to him.
