The First Bail Application (BA1 No.1030 of 2025) was dismissed as withdrawn on 17.06.2025 granting liberty to the applicant to file a fresh bail application. 3. The applicant – Kuldeep Nandrajog is in judicial custody under Section 420 and Section 120B of the Indian Penal Code, 1860 in Case Crime No.32 of 2024, registered at Police Station Bahadarabad, District Haridwar. 4. According to the First Information Report dated 04.02.2024, the informant Vipin Tyagi purchased a flat from the applicant in the year, 2012, but he is not giving him possession of the said flat. 5. Heard Mr. Sharang Dhulia, learned counsel for the applicant and Mr. Tumul Nainwal, learned Assistant Government Advocate for the respondent. 1 2025:UHC:7333 6. Mr. Sharang Dhulia, Advocate, contended that the said allegation is totally false. Applicant is a builder. An Agreement was executed between the informant and the applicant. Applicant did not follow the conditions of Clause 12 and Clause 49 of the Agreement. There is also an arbitration clause in the said Agreement. Applicant has been granted regular bail in two cases by the Coordinate Bench. Applicant is not a convicted person. He is a permanent resident of Delhi, therefore, there is no possibility of his absconding. 7. Mr. Tumul Nainwal, Assistant Government Advocate, has opposed the bail application orally. 8. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merits of the case, this Court is of the view that the applicant deserves bail at this stage. 9. The Second Bail Application is allowed. 10. Let the applicant – Kuldeep Nandrajog be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned. ___________________ Date: 20.08.2025 ALOK KUMAR VERMA, J.
