JUSTICE S.R.KRISHNA KUMAR Digitally signed by SHARADAVANI B Location: High Court of Karnataka - 2 - HC-KAR NC: 2025:KHC:39734 WP No. 25095 of 2025 ORAL ORDER In this petition petitioner seeks the following reliefs- a) Issue a Writ, order or direction in the nature of Mandamus to the respondent to provide a 5 Grace Marks in one subject to the petitioners. b) Pass such other orders/discretions as this Hon'ble Court may deem it fit and proper considering the facts and circumstanced of this case, in the interest of justice and equity. 2. Heard learned counsel for the petitioner and learned counsel for the respondent and perused the material on record. 3. A perusal of the material on record will indicate that in the examination of third year professional BMS Course taken by the petitioner during March 2025, under the RS 5 Scheme 2018 Batch, the petitioner obtained 41 marks which fell short of the minimum requirement due to which the petitioner was declared as 'failed' in the results announced during June, 2023. 4. The limited grievance of the petitioner in the present position is for awarding 5 additional grace marks in relation to the aforesaid examination. However, even assuming that the respondent were to award 5 additional grace marks in - 3 - HC-KAR NC: 2025:KHC:39734 WP No. 25095 of 2025 favour of the petitioner, the total number of marks obtained by the petitioner would come to 46 marks, which would still be well short of the minimum passing marks of 50.
