Issue an order, direction directing the Additional Upziladhikari Sadar, Tehsil Sadar, District- Mirzapur to decide and dispose of the illegal and highly time barred Recall/Restoration Application Dated 29.06.2021 in Revenue Case no- 145/414 of 1989 Omprakash Vs State and others U/s 229B of U.P.Z.A. within a short-stipulated period of time." It is contended that restoration application is pending in proceedings under Section 229B of the U.P.Z.A. & L.R. Act. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.1- Additional Upziladhikari Sadar, Tehsil Sadar, District- Mirzapur to decide the restoration application pending in proceedings under Section 229B of the U.P.Z.A. & L.R. Act, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
