Applicant has sought transfer of proceedings of Criminal Complaint Case No. 20 of 2024, pending before Judicial Magistrate, 1st Class, Tharali, District Chamoli to Court of Chief Judicial Magistrate, Rudrapur, District Udham Singh Nagar. 3. It is contended that due to her medical condition, applicant is not able to visit Tharali for contesting the case on each and every date fixed in the matter. 4. Learned counsel for the applicant submits that applicant is suffering from muscle pain and she also has motion sickness while travelling in the hills. 5. The ground taken for seeking transfer does not appear to be valid. Transfer Application is accordingly dismissed. 6. However, applicant shall be at liberty to move application, seeking exemption from personal appearance before the Court at Tharali, which shall be considered on merit as per law.
