No. 1430 of 2025 __________ Page4 of 8 ORDER This writ petition has been filed for direction directing the respondents 1 to 18 to take action against the nineteenth respondent, thereby, seeking cancellation of the Overseas Citizen of India Card issued in favour of the nineteenth respondent. 2.On perusal of the records and also on hearing the learned Senior Counsel for the nineteenth respondent reveal that on the complaint lodged by the nineteenth respondent, the Inspector of Police, CCB Avadi, Chennai, registered the FIR in Crime No.38/2024 for the offence punishable under Sections 406, 409, 465, 468, 467, 420 of IPC and investigation conducted and final report submitted and the same was taken cognizance in C.C.No.16 of 2026 on the file of the learned Judicial Magistrate No.I, Poonamallee. While pending investigation, the petitioner's Principal lodged complaint before the respondents 3 and 5 dated 01.06.2024 seeking cancellation of Overseas Citizen of India Card issued in favour of the nineteenth respondent. 3.The nineteenth respondent is of Indian origin and he obtained Overseas Citizen of India Card to visit India frequently and to stay in India without any restriction and it cannot be cancelled automatically, unless the nineteenth https://www.mhc.tn.gov.in/judis WP Crl. That apart, the petitioner's Principal lodged complaint only inorder to escape from the clutches of law initiated by the nineteenth respondent now pending trial in C.C.No.16 of 2026 on the file of the learned Judicial Magistrate No.I, Poonamallee. That apart, the complaint lodged by the petitioner's Principal was enquired and the same was closed. 4.In view of the above, the prayer sought for cannot be granted.
