Learned counsel for the petitioner submits that the matter is cognizable by the Authority under Consumer Protection Act. 2. The dispute is primarily a consumer dispute between petitioner and the respondent No. 1 and 2 and it appears that present writ petition was filed only because no Forums under the Consumer Protection Act were functional in the Union Territory of Jammu and Kashmir at the relevant point of time. Now the Forums under the Consumer Protection Act are functional, as such, this Court permits the petitioner to file a complaint before appropriate Forums under the Consumer Protection Act and the petitioner is granted thirty days time from today to file a complaint and in the event same is filed, the period of limitation shall not come in the way of the petitioner and the learned Authority under the Consumer Forum Act shall decide the complaint in accordance with law.
