NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following reliefs: (i) Issue a writ of mandamus or any other writ directing the respondents to consider the representation of petitioner dated 05.10.2018 and 19.05.2023 produced as Annexures M and N, in terms of selection list dated 17.03.2015 (Annexure- C), in the interest of justice and equity. (ii) Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondents to consider the case of the petitioner for appointment to the post of Hindi Teacher in the services of the schools run/controlled by the Karnataka Residential Educational Institutions Society from the date on which the respondents have appointed Teachers in the year 2012 with effect from occurrence of the vacancy or whichever is earlier and grant them fixation of pay, arrears of - 3 - HC-KAR NC: 2025:KHC:28000 WP No. 20908 of 2023 salary and increments and all the consequential benefits to meet the ends of justice.” 2. The respondent No.2 issued a notification calling applications to fill up certain posts as per Annexure-B dated 27.04.2011. Pursuant to that, the petitioner applied for the post of Hindi Teacher. After considering the applications submitted by the petitioner and other candidates, the final selection list was issued as per Annexure-C dated 17.03.2015, selecting the petitioner as Hindi Teacher in the second respondent – Society. Thereafter, vide Annexure-D dated 05.06.2015, the second respondent called for some clarifications from the petitioner. Pursuant to Annexure-D, the petitioner submitted the affidavit dated 15.06.2015 vide Annexure-E. enclosing all necessary documents, which was called for by the second respondent in the notice dated 05.06.2015. Thereafter, no action was taken. Till today, no appointment order has been issued. Hence, the petitioner submitted a representation dated 05.10.2018 vide - 4 - HC-KAR NC: 2025:KHC:28000 WP No. 20908 of 2023 Annexure-M to the second respondent. So far, no action has been taken on the said representation. 3. Under these circumstances, it is suffice for this Court to direct the second respondent to consider the representation submitted by the petitioner, vide Annexure- M dated 05.10.2018 and pass appropriate orders, in accordance with law, as expeditiously as possible, not later than three months from the date of receipt of a copy of this order. It is made clear that, till taking a decision, the respondents are directed not to terminate the services of the petitioner. With the above observations, the writ petition stands disposed of.
