This is the second bail application under Section 439 of Code of Criminal Procedure filed by the applicant- Pyarelal Singh, seeking enlargement on bail during trial in connection with Case Crime No.40 of 2021, under Sections 323, 504, 376DA IPC and 3/4 POCSO Act, registered at P.S. Husainganj, District- Fatehpur. 4. The first bail application of the applicant being Criminal Misc. Bail Application No. 53799 of 2021 was rejected by this Court on 12.4.2022. 5. This bail application is having serious typographical errors inasmuch as the statement of the victim who was examined as P.W.-1 before the trial court on 11.03.2024 is being relied and is being placed before the Court annexed at Page No. 78 of the paper book. Reading of the said statement does not make out any sense as is totally out of context. 6. In view of the same, the present second bail application stands dismissed. 7. After this order was passed, learned counsel for the applicant prays that the present second bail application be dismissed as withdrawn as he intends to file a better bail application. 8.
