No. 788 of 2025 ORDER This writ petition has been filed to direct the respondents to take action on the petitioner's representation dated 17.03.2025. 2. According to the petitioner, the original document bearing Nos. 4762/1984 and 4679/1984 were misplaced on 06.03.2025 while they returning home after registration of Power of attorney and correctional deed (No.38/2025). Hence, the petitioner gave a representation before the respondent police, but no action was taken till date. 3. Heard the learned Government Advocate(crl.side) appearing for the respondents and perused the materials available on records carefully. 4. The contention of the petitioner is that the missing documents have neither been recovered nor any non-traceable certificate has been issued by the respondent police. It is further contended that the non-traceable certificate is required only for the purpose of registration. Now it is to be noted that Rule 55A 2/4 https://www.mhc.tn.gov.in/judis WP Crl. No. 788 of 2025 of the Tamil Nadu Registration Rules has been struck down by the Supreme Court in Civil Appeal No.3954 of 2025 by order dated 07.04.2025. Thereafter, the Inspector General of Registration has issued circular Lr.No.44420/C1/2024, dated 28.04.2025, wherein it is clearly directed the Sub-Registrar that the Registering officials shall not insist the production of original previous documents or non-traceable certificate from the Police Department or encumbrance certificate and other revenue details from the registrants. 5. In view of the above circular, non-traceable certificate from the Police is not at all required.
