Counsel for the Writ Petitioner (appearing through online) and Sri Arjun Chowdary, Ld. Asst. Government Pleader for Revenue. 2. The present Writ Petition is filed seeking a direction to the Official Respondents to consider the Representation of the Writ Petitioner dated 02.01.2025 for laying of the road (Ex.P.1). 3. Learned Asst. Government Pleader has submitted the Written Instructions dated 25.02.2025. Copy of it is not supplied to the learned Counsel for the Writ Petitioner, because the Counsel is appearing online. The same is taken on record. 4. The relevant portion of the Written Instructions is usefully extracted hereunder: “It is submit that the land in sy.no.56/10 extent 0.85 cts of Laddigam village stands as Cheruvu as per SLR of Laddigam village..as the petitioner has earlier encroached the subject land and there is an representation has received from the villagers of Laddigam village for removal of encroachment over the subject land, in this regard the encroachment over the subject land has evicted and land has been restored as Cheruvu. It is further submit that at present the subject land lying vacant, and there is no question of laying road over the subject land as stated by the writ petitioner in the writ affidavit. In the circumstances stated above I request that facts may kindly be appraised to the Hon’ble High Court of AP and for disposal of WP.No.4960/2025 at the admission stage itself.” 5. The above extract would indicate that the subject land situated in Survey No.56/10 was encroached earlier; that the land is classified as ‘Cheruvu’; and, therefore, the encroachments were cleared and it has been restored to the Government. The land is lying vacant and that there is no 3 question of laying road over the said land, because the said land is classified as ‘Cheruvu’. 6. Having regard to the above instructions, this Court is of the opinion that since the subject land is classified as ‘Cheruvu’, it is covered by the Judgment of Hon’ble Apex Court in Hinch Lal Tiwari Vs. Kamala Devi and others; (2001) 6 SCC 496. Therefore, no mandamus can be granted in favour of the Writ Petitioner in this regard. 7. Accordingly, this Writ Petition is dismissed as being devoid of any merit. No order as to costs. 8.
