Neutral Citation No. - 2025:AHC:137909-DB Court No. - 29 Case :- WRIT - C No. - 26371 of 2025 Petitioner :- Rajeev Kumar Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Raj Narayan Tiwari Counsel for Respondent :- C.S.C.,Raghuvansh Misra,Tejasvi Misra Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J.
1. Heard learned counsel for the petitioner; Shri Devesh Vikram, learned Addl. Chief Standing Counsel for State respondents and Shri Tejaswi Misra, learned counsel for Ghaziabad Development Authority (in short "GDA").
2. The instant writ petition has been preferred for a direction to respondent no.2 to make payment of compensation for the acquired land of the petitioner for the purposes of road construction as per the G.O. dated 12.05.2016 and for a further direction to respondent no.2 to consider and decide the representation of the petitioners dated 12.07.2025 within stipulated period.
3. Learned counsel for the petitioners submits that the land in question has been acquired by the respondent-Authority without due process of acquisition and even the compensation has not been given to him of the acquired land. Learned counsel for the petitioner, in this backdrop, submits that the claim of the petitioner is to be redressed by taking note to the Government Order dated 12.05.2016 by the District Level Committee.
4. Confronted with the above situation, learned counsel for the contesting-respondents very fairly conceded the fact that if the claim as has been set up by the petitioner herein comes within the
ambit/scope of Government Order dated 12.05.2016, definitely the same shall be redressed by the District Level Committee.
5. Accordingly, we dispose of the instant petition with liberty to the petitioner to make fresh representation along with true attested copy of the instant order before respondent no.2 within three weeks. In the event, such representation is made, respondent no.2 will transmit the same to the Chairperson of the Committee for being decided in terms of Government Order dated 12.05.2016 by the Committee within next two months after proper survey and opportunity of hearing to the petitioner and all stake holders in the matter.
