For Petitioner(s): Mr.B.Shakthivel For Respondent(s): Mr.R.Ganesh Kumar, Counsel for Government of Tamilnadu (Crl.Side)for R1 to R3 Assisted by Mohammed Imran A ORDER This Writ Petition (Criminal) has been filed by the petitioner seeking to quash the proceedings in G.O.I.D.No.514 dated 04.12.2024 and to direct the respondent to the release the petitioner’s husband, Mannan Miah Alias Abdul Mannan, from Special Camp Prison, Tiruchirappalli, and set him at liberty, enabling him to defend the criminal case initiated by the third respondent and to reside with the petitioner and their daughter. 2. The Petitioner’s husband namely Mannan Miah Alias Abdul Mannan is a Bangladeshi National had come to India in the year 2002 and settled in Tripura, India. He had previously married a woman, who is a Tripura Native in Tripura and later divorced her. Thereafter, he had come to Chennai and had married the petitioner herein. https://www.mhc.tn.gov.in/judis

While being so, the petitioner’s husband was arrested on 25.10.2024 in pursuant to the registration of Cr.No.139 of 2024 for the offences punishable under Sections 12(1) and 12(1A) of the Passport Act, 1967 and Sections 420, 468 and 471 of IPC. He was also granted bail. After the completion of investigation, the third respondent filed a final report and the same has been taken cognizance by the trial court. Now, the petitioner’s husband is facing trial in C.C.No.601 of 2025 on the file of the learned Judicial Magistrate-I, Alandur, Chennai.Though the petitioner was granted bail, he was directed to stay in Special Camp Prison, Tiruchirappalli, since he is the Foreign National. 4. The Petitioner stated that the detenu has been a continuous resident of India for over four decades and is the lawful husband of the petitioner, an Indian Citizen. The parents of the detenu settled in Tripura and the detenu was born on
01.01.1987. The detenu holds valid educational and identity documents, including a Transfer Certificate from Melager, Tripura, Aadhaar Card, Election Commission Voter’s ID issued in Tripura and Tamilnadu. The detenu is not an illegal migrant, has no criminal antecedents, and is the sold bread winner of the his family. 5. Accordingly, G.O.I.D.No.514 dated 04.12.2024 is hereby set aside with the condition that the detenu shall not claim his passport before the trial Court. The trial Court is directed to complete the trial within a period of 12 weeks from the date of receipt of a copy of this Order. 6. The petitioner shall also file an affidavit to the extent that her husband will not abscond anywhere and also co-operate with the trial in C.C.No.601 of 2025 on the file of the learned Judicial Magistrate-I, Alandur, Chennai. 7.
