07.08.2025. Learned senior counsel for the petitioner, Mr. H.S. Paonam and also Mr. Kh. Samarjeet learned DSGI for the respondents/Union of India are present before the Court physically. This writ petition has been filed by the petitioner against the respondents/Union of India with 3 Ors whereby in this writ petition seeking for setting aside the impugned inquiry report dated 08.07.2016. Whereas, the learned senior counsel for the petitioner in this matter submitted for consideration of the affidavit as filed on behalf of the respondent Nos.1, 2 & 3 whereas in para No.7 of this affidavit reveals as inquiry report dated 08.07.2016 and subsequent comprehensive enquiry report in terms of order dated 12.07.2016 did not culminate in the issuance of any charge sheet or initiation of any disciplinary proceeding against the petitioner. Furthermore, it is stated that no punitive action has

been taken by the institute against the petitioner till date. It is further submitted that the inquiry proceedings were limited to examining the circumstances surrounding the management and treatment of Smt. Th. Kheroda Devi who was admitted in the Antenatal Ward of RIMS Hospital on 04.07.2016 and unfortunately expired on 06.07.2016, it is further submitted that the inquiry report, institution has not been initiated in disciplinary proceeding against the petitioner in relation to the accident. Whereas in Para No.11 of this affidavit reveals as State Consumer Dispute Redressel Commission , Manipur disposed of the complaint case No.1/.2017 vide order dated 21.10.2024 directing the opposite party in the aforesaid complaint page Nos. 4, 5 & 6 (i.e., Director, Medical Superintendent and RIMS) to pay compensation of Rs.22,24,408/- jointly and severally, within a period of three months. It is pertinent to state that no adverse funding was recorded by the aforesaid State Consumer Dispute Redressal Commission specifically against the present petitioner whereas in Para No.13 of the affidavit reveals that the petitioner vide order dated 25.04.2019 was promoted to Asstt. Professor and consequently on 06.05.2024, the petitioner was promoted from Asstt. Professor to Associate Professor.
The aforesaid learned senior counsel in this writ petition submitted that to consideration of the aforesaid Para Nos. 7, 8, 11 and 13 and

wherein in detail has been stated in respect of the issue as has been reported to the addressed to this writ petition and therefore, the learned senior counsel clearly submitted that the consideration of aforesaid paragraphs specifically in the writ petition and submitting for this writ petition has to be disposed it of. This order has been rendered in the presence of the learned senior counsel Mr. Kh. Samarjit, DSGI whereby representing the Union of India and 3 Ors being in the rank of respondents.
