3. Petitioner has challenged the
judgment dated 04.01.2025 passed by Deputy Director Consolidation/Collector, Haridwar in Revision No. 81 of 2023-24. By the said judgment, order dated 14.06.2024 passed by Settlement Officer Consolidation, whereby appeal filed by respondent nos. 2 to 7 was entertained without considering the delay condonation application, was set aside and the matter was remanded to the Settlement Officer Consolidation to decide the delay condonation application on merits by passing a reasoned and speaking order.
4. Learned State Counsel points out that in the proceedings before Settlement Officer Consolidation, the next date fixed, is 04.07.2025.
5. This Court does not find any reason to interfere in the matter. Learned Deputy Director Consolidation has rightly interfered with the order passed by Settlement Officer Consolidation, as he had entertained the appeal without considering the delay condonation application. Thus, there is no scope for interference.
6. Accordingly, the writ petition fails and is dismissed. It is, however, made
clear that Settlement Officer Consolidation shall decide the appeal on merits, without being influenced by any observation made in this order.
