It is argued that in the proceedings initiated by the Private- respondents namely Respondent Nos. 7 & 8 before the Prescribed Authority, under the Ceiling Act, Kushinagar, pursuant to the application filed by them under Section 141 C.P.C. is pending consideration since 2011. As soon as the petitioner came to know regarding the aforesaid proceedings, he moved an application to decide the aforesaid case. 2. It is further argued that as per the information provided by the office of the aforesaid respondents, the next date was fixed 22.07.2025. 3. In this view of the matter, a prayer has been made by the counsel for the petitioner to direct the Respondent No. 3/Niyat Pradhikari/ Upper Zila Adhikari, District Kushingar to decide the aforesaid application, expeditiously. 4. Heard counsel for the petitioner and learned Standing Counsel for the respondent nos. 1 to 5. 5. In view of the order proposed to be passed today, the notices need not be issued to the private-respondents. 6. In this view of the matter and also in the interest of justice, the present writ petition is disposed of finally directing the Respondent No. 2, District Magistrate, Kushinagar to decide the application submitted by the petitioner, expeditiously.
