JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 24-02-2025 Heard learned counsel for the petitioner and the State. 2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. 3. As per prosecution case, during course of raid, 535.68 liters foreign liquor was recovered from Mahindra car, 501.12 liters foreign liquor was recovered from the car and 172.8 liters foreign liquor was recovered from the hut of co- accused Baleshwar Rai. 4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. He has been made accused in this case only on suspicion. 5. Learned A.P.P. for the State opposes the prayer for Patna High Court CR. MISC. No.4536 of 2025(2) dt.24-02-2025 2/2 bail and submits that the petitioner has got three criminal antecedents out of which two antecedents are of similar nature. 6.
