Heard the parties.
The petitioner has been made accused in connection with Mango P.S. Case No. 245/2024, for the offences registered under Sections 191 (1), 191(3), 190, 126(2), 127(2), 103(1), 109, 118(1), 117(2), 118(2), 324(4), 324(5), 352, 351(2), 351(3) & 61(2) of the B.N.S., 2023 and Section 27 of the Arms Act, pending in the Court of Sri Sidhant Tigga, learned J.M., 1st Class, Jamshedpur. On 02.09.2024 at 7.00 p.m., son of the Informant namely Shakti Nath Singh @ Dablu was shot dead by co-accused Mantu Gour and unknown person. Suspicion has been raised upon the petitioner that he might have conspired the commission of the aforesaid offence. Learned senior counsel for the petitioner submitted that apart from suspicion there is no other material against the petitioner on the record. It was further submitted that similarly situated co-accused persons have been granted bail by this Court earlier. Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.
In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Sidhant Tigga, learned J.M., 1st Class, Jamshedpur or his successor, in connection with Mango P.S. Case No. 245/2024.
