JUSTICE BISWAJIT PALIT Order 15/05/2025 Heard Mr. Tapash Datta Majumdar, learned senior counsel assisted by Mr. Dalit Kalai, learned counsel for the petitioner. The grievance of the petitioner is that respondents-ONGC has not refunded 50% of the service tax paid by him in connection with the civil works executed at Drill Site BAAA in Hirapur, Tripura under agreement No.Agartala/Es/Civil/10(1408)/2014-15 dated 07.03.2015. According to the petitioner, respondents have issued completion certificate on 05.03.2018 [Annexure-2] on satisfactory completion of the work. Learned senior counsel for the petitioner however submits that inadvertently averments relating to the actual deposit of the service tax on behalf of the petitioner in the writ petition have not been correctly stated. Therefore, he seeks permission to withdraw the present writ petition with liberty to file a fresh writ petition with correct averments. Liberty is allowed.
