Appropriate writ, order or direction in the nature of Mandamus directing the Respondents to Consider the Representation dated 04.07.2025 herein produced at ANNEXURE N.; ii. Appropriate writ, order or direction in the nature of Mandamus directing the Respondents to issue Khata Certificate to the Petitioner herein. iii. Such other writ, order or direction as this Hon'ble Court deems fit in the facts and circumstances of the case, including the cost of the Writ Petition in the interest of justice and equity.” 2. Heard the learned counsel for the petitioner and learned counsel appearing for the respondents. Perused the material on record. 3. The Respondent No.1-BDA issued allotment letters in favour of the petitioner for the plots situated in - 3 - HC-KAR NC: 2025:KHC:42126 WP No. 28328 of 2025 Sy.Nos.85/1B and 85/1C. Pursuant thereto, the BDA executed registered sale deeds in favour of the petitioner and issued possession certificate in favour of the petitioner. The petitioner thereafter submitted a representation seeking issuance of a katha certificate for the plots allotted in her favour. The grievance of the petitioner is that, despite lapse of more than two months, the BDA has not issued the katha certificate. 4. Learned counsel for respondent No.1 submits that the representation submitted by the petitioner at Annexure-N will be considered in accordance with law, and that necessary katha certificate would be issued, if the documents are found to be in order. 5. The submission is recorded. 6. The petitioner claims to be the absolute owner of the schedule properties, which were allotted under the ‘Alternate Site Allotment Scheme’. The BDA has executed valid sale deeds and issued possession certificate in her favour. From the above proceedings, it is evident that plot Nos.105, 118A, 118B, 118C and 118D do not form part - 5 - HC-KAR NC: 2025:KHC:42126 WP No. 28328 of 2025 of the disputes in W.P.No.20066/2022 and W.P.No.18906/2023. In light of the same, there is no impediment for the respondent-BDA to issue a katha certificate in favour of the petitioner, considering the registered sale deeds and possession certificate already issued in her favour. Accordingly, this Court deems it appropriate to direct the respondent-BDA to consider the representation of the petitioner and issue katha certificate. Accordingly, this Court pass the following: ORDER i. The writ petition is allowed-in-part. ii. Respondents-BDA are directed to consider the representation dated 04.07.2025 (Annexure-N) and issue katha certificate to the petitioner within an outer limit of four weeks from the date of receipt of the certified copy of this order.
