Neutral Citation No. - 2025:AHC:84739 Court No. - 47 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 28795 of 2024 Applicant :- Asif Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Amit Kumar Shukla,Subhash Chandra Yadav Counsel for Opposite Party :- G.A.,Shyam Shankar Mishra Hon'ble Siddharth,J. Heard learned counsel for the applicant; Sri Vijay Kumar Mishra, Advocate, holding brief of Sri Shyam Shankar Mishra, learned counsel for the informant; learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Asif, with a prayer to release him on bail in Case Crime No. 271 of 2024, under Sections 376-AB, 354, 354-A, 354B IPC and Section 5m/6 POCSO Act, Police Station Loni, District- Ghaziabad, during pendency of trial. There are allegations against the applicant of committing the offence of rape against a minor girl. Learned counsel for the applicant has submitted that applicant has falsely been implicated in this case. Learned counsel for the informant and learned AGA have vehemently opposed the prayer for bail of the applicant. This Court, after hearing the learned counsels for the parties, does not finds any ground for enlarging the applicant on bail at this stage since there is CCTV footage of dragging the victim inside the toilet by the applicant, where alleged offence was committed. The bail application is, accordingly, rejected. The trial court is directed to conclude the trial against the applicant, as expeditiously as possible, as per Section 346 B.N.S.S./309 Cr.P.C.
