The petitioner is before this Court seeking for the following reliefs: "QUASH the ADDENDUM AND CLARIFICATIONS:1 Dtd. 10/09/2024 (ANNEXURE:A) in No: CFS/IT-04/WS- TENDER/01/2024-26 so far as Sl. NO:30 & 33 are concerned therein; b. QUASH the 2nd Respondent's communication dated 18/10/2024 (ANNEXURE:C) Issued to Petitioner in respect of Bangalore Urban-East regarding Technical Bid evaluation; C. Consequently declare that the Petitioner is qualified as per tender condition in "Minimum Eligibility criteria" listed under Clause:4 (ix) of Original Tender dated 23/08/2024 (ANNEXURE:B) and also in ADDENDUM AND CLARIFICATION:1, Dtd. 10/09/2024 (ANNEXURE:A) vide No:CFS/IT-04/WS-TENDER/01/2024-26 in Page:12 Point:12 therein; d. Learned counsel for the petitioner seeks permission to withdraw the above petition and file an appeal under Section 16 of the Karnataka Transparency in Public Procurements Act, 1999. Reserving such liberty the petition stands disposed of. The interim order earlier granted is extended until 05.01.2026 to enable the petitioner to file the appeal. 3. If the appeal is not filed by 05.01.2026, the interim order shall stand automatically vacated. 4. It is for the appellate authority to consider the application for extension of interim order post 05.01.2026. 5. The appellate authority is directed to dispose the appeal as expeditiously as possible preferably within a period of 30 days from the date of filing of the appeal.
