This writ petition has been filed with the following prayer:- "(i) Issue a writ order or direction in the nature of writ of mandamus commanding and directing the Sub Divisional Magistrate, Modi Nagar, Ghaziabad to decide the plaintiff/petitioner's application dated 29.11.2023 in Case No.28 (Atar Singh (deceased) 1/1 Siptter Singh Vs. State of U.P. & others) within a stipulated period of time as fixed by this Hon'ble Court;" It is contended that in the declaratory suit filed by the petitioner, an application has been moved which is pending consideration since 2023. The sole prayer made in the writ petition is for expeditious disposal of the said application. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon authority concerned to decide the application dated 29.11.2023, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
