Neutral Citation No. - 2025:AHC:133867-DB Court No. - 21 Case :- WRIT - C No. - 26535 of 2025 Petitioner :- Baburam Singh Sengar Respondent :- State Of Uttar Pradesh And 5 Others Counsel for Petitioner :- Raj Narayan Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. The present petition has been filed praying for a writ of mandamus commanding respondent no. 2 to pass appropriate orders on the complaint of the petitioner made against private respondents no. 4, 5 and 6. 2. A perusal of material brought on record alongwith writ petition reveals that the petitioner claims a partition of the joint holding of the parties on the basis of a family settlement and claims to have sold the trees standing on the land, falling to his share. However, the private respondents, who are nephews of the petitioner, are objecting to the cutting of the trees and thus denying the alleged family settlement. 3. In our considered opinion, the dispute of such nature between two set of private parties, cannot be decided in writ jurisdiction nor we consider it appropriate to direct executive authorities to investigate the issue on basis of representation made on the administrative side. 4. The petition stands disposed of with liberty to the petitioner to avail appropriate remedy under the law. . (R.M.N. Mishra, J.) (Manoj Kumar Gupta, J.)
