JUSTICE PRAVEER BHATNAGAR Order 25/02/2025 1. Apprehending their arrest in connection with FIR No. 191/2024 registered at Police Station Kaithwada District Deeg, for the offence(s) under Sections 303(2), 317(2), 319(2), 318(4), 338, [2025:RJ-JP:8376] (2 of 3) [CRLMB-2728/2025] 336(3), 340(2), 308(2), 61(2) (A) of BNS and Section 66-D of IT Act the petitioners have preferred these anticipatory bail applications under Section 482 BNSS. 2. Learned counsel for the accused-petitioners submits that petitioners have falsely been implicated in this case. It is contended that recovery of sim cards, mobile phones etc. have already been effected from the possession of other co-accused. The trial of the case will take considerable time and custodial investigation of the accused petitioners is not required. Petitioners are ready and willing to cooperate with the investigation and there are no criminal antecedents against the petitioners. Considering the above facts, the bail applications of petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail applications. 4. I have considered the overall allegations levelled in the FIR and contentions made by the counsel for the parties. 5. Considering the fact that custodial investigation of the present petitioners is not required and the offences alleged to have been committed by the petitioners are triable by Magistrate, there are no criminal antecedents against the accused-petitioners, without expressing anything on merits of the case I deem it just and proper to allow the anticipatory bail applications of the accused-petitioners. 6. Accordingly, the anticipatory bail applications under Section 482 BNSS. are allowed and it is ordered that in the event of arrest of the petitioners- 1. Mausim S/o Mahmood @ Mota, 2.
