JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 2 08-01-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-B) (a) 26, 35 of the Arms Act. 3. As per FIR, petitioner along with other accused persons are said to have assembled with illegal arms for preparation of dacoity and some of them were nabbed with arms and ammunition by the police. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has been made accused in this case on the basis of disclosure made by the co-accused. He Patna High Court CR. MISC. No.87494 of 2024(2) dt.08-01-2025 2/2 further submits that petitioner has three criminal antecedents as stated in para-3 of the bail application. 5. Learned APP for the State opposes the prayer for bail. 6. Considering the facts and circumstances of the case and the nature of office, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Saharsa Sadar P.S. Case No. 318 of 2024. devendra/- (Anjani Kumar Sharan, J) U T
