No. 6767 of 2024 Learned counsel for the petitioner submits that this writ petition is not identical to C.W.J.C. Nos. 13488 of 2023 and C.W.J.C. No. 18747 of 2024 and therefore this case may be segregated from the aforesaid writ petitions. 2. As prayed for by learned counsel for the petitioner, C.W.J.C. No. 6767 of 2024 is segregated from C.W.J.C. Nos. 13488 of 2023 and 18747 of 2024. 3. List this case on 3rd of July, 2025. Re: C.W.J.C. No. C.W.J.C. No. 13488 of 2023 and C.W.J.C. No. 18747 of 2024. 4. Heard learned counsel for the parties. 5. In both the writ petitions, the petitioners have prayed for the following reliefs:- “a) For issuance of appropriate writ, order/orders or direction in the nature of writ of certiorari quashing the impugned notification dated 26.06.2021 by means which the STET- Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 38/47 2019 competitive examination which was conducted for the purpose of appointment has now been converted into a qualifying examination without assigning any valid reason. b) For issuance of an appropriate writ, order/orders or direction in the nature of writ of mandamus commanding the Respondent authorities to immediately appoint the petitioners against 30,675 posts of teachers under the category of state employees as the petitioners have already qualified and are within subject wise and vacancy wise merit in the STET 2019 competitive examination which was conducted for the purpose of appointment only. c) For issuance of appropriate writ, order/orders, or direction in the nature of writ of mandamus directing the respondents not to proceed for conducting examination on 30,675 posts only (on which the petitioners are already in merit) out of 90,518 posts which has been advertised vide Advertisement no. 26/2023 dated 30.05.2023 so far as it relates to the secondary and higher secondary teachers. d) For issuance of appropriate writ, order/orders, or direction in the nature of writ of mandamus, commanding the Bihar Public Service Commission (hereafter referred as B.P.S.C.) for reserving / holding 30,675 posts out of total advertised 90,518 posts on which the petitioners and other similarly situated meritorious candidates qualified the STET-2019 but appointment was not done since last about 4 Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 39/47 years.” 6. In both the writ petitions, the petitioners have put to challenge the notification dated 26.06.2021, issued by Deputy Secretary, Education Department, Government of Bihar, by means of which, STET, 2019 competitive examination, which was conducted for the purpose of appointment, has been converted into a qualifying examination. Though, detail description of the impugned notification dated 26.06.2021 has not been given in the prayer column of the writ petitions, but the petitioners have enclosed the aforesaid impugned notification dated 26.06.2021 as Annexure-23 to C.W.J.C. No. 13488 of 2023. 7. Respondent no. 2 has filed a counter affidavit in C.W.J.C. No. 13488 of 2023, wherein it has been pointed out that the notification dated 26.06.2021, which has been put to challenge in the present two writ petitions, has already been adjudicated by this Court in two different writ petitions filed by different but similarly situated persons being C.W.J.C. No. 13312 of 2021 ( Bipin Kumar Mishra Vs. The State of Bihar and Ors) and C.W.J.C. No. 12481 of 2021 (Alok Kumar & Ors. Vs. the State of Bihar & Ors.), wherein, a co-ordinate Bench of this Court has rendered a detailed judgments dated 18.04.2022 Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 40/47 (Annexure-R1 to the counter affidavit) and 20.06.2022 (Annexure-R2 to the counter affidavit), respectively. 8. Respondent nos. 1 and 2 have also filed a counter affidavit in C.W.J.C. No. 18747 of 2024, wherein, it has been pointed out that against the judgment dated 18.04.2022, passed by the learned Single Judge in C.W.J.C. No. 13312 of 2021, an L.P.A. No. 275 of 2022 was preferred, which was also dismissed by the L.P.A. Court upholding the judgment dated 18.04.2022, passed by learned Single Judge in C.W.J.C. No. 13312 of 2021. 9. The petitioners have filed rejoinder to the counter affidavit filed by respondent no.2 in C.W.J.C. No. 13488 of 2023, in which the petitioners have also enclosed a copy of the writ petitions being C.W.J.C. No. 13312 of 2021 and C.W.J.C. No. 12481 of 2021, as Annexure-R1 to the reply to the counter affidavit filed by respondent no.2. 10. To ascertain as to whether the prayer made in C.W.J.C. No.13312 of 2021 and C.W.J.C. No. 12481 of 2021 by the petitioners therein is identical to the prayers made by the petitioners in the present two writ petitions, the prayer made in C.W.J.C. No. 13312 of 2021 and C.W.J.C. No. 12481 of 2021 are also reproduced hereinbelow for ready reference:- C.W.J.C. No. 13312 of 2021 “1. a) For issuance of such other order/orders, Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 41/47 direction/directions, writ/writs in the nature of Certiorari quashing the Memo No. 09/Ma.Shi.Pa.P. (2019)-01/2020 414 dated 26.06.2021 (Annexure-P/9) wherein the Committee constituted by the Education Department under Chairmanship of Secretary, Education Department has recommended that candidates having qualified STET 2011 would be also eligible for appointment along with STET 2019 candidates inspite of the facts they have not applied under the advertisement. b) For issuance of order/orders, direction/directions or writ/writs in the nature of Mandamus directing the Respondent authorities to declare the result of all the candidates along with their cut off marks in the categories who have appeared in the On-Line Examination for Secondary Teacher Eligibility Test, (STET), 2019 held for appointment against the vacancies advertised in the Notification between 09.09.2020 to 21.09.2020 pursuant to the Notification No. P.R. 182/2020 dated 10.08.2020 (Annexure-P/3) (herein after referred as Notification). c) For issuance of writ in the nature of directing the respondent authorities to publish the merit list as per the advertisement appoint the candidates in order of merit.” C.W.J.C. That by the present writ petition, the poor and helpless unemployed petitioners craves indulgence Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 42/47 before this Hon’ble Court for grant of the following reliefs:- (i) That the impugned order dated 16-05-2020 bearing Memo No. 151/2020 passed by the Examination Controller (Misc.) Bihar School Examination Board, Bihar, Patna with regard to STET-2019 contained in Annexure-5 may kindly be finally set aside in concern with the petitioner and similarly situated those other persons upon whom Examination Centres no unfair meanses, no malpractices or any kind of disturbances had been done at all. (ii) That the writ of mandamus be issued, strictly, directing the Respondents, to publish the result of the petitioner and those similarly situated persons, upon whom Examination Centre no malpractice, no unfair means or no any disturbances have been reported in inquiry report of 4 Men Committee constituted by the Bihar School Examination Board itself. (iii) That if petitioner succeed in result of STET Exam-2019, the Respondents be further directed to appoint such persons including the petitioner forthwith because due to 37000 vacant seats of the teachers in Secondary and 10+2 schools since last 10 years in bihar due to which the innocent students of the concern schools are suffering a lot. (iv) That the Respondents be also directed pay the appropriate cost and compensation for unnecessary mental, physical and economical harassment done by the illegal and unconstitutional acts of the Respondents. (v) That any other relief or reliefs may kindly be granted in favour of the petitioner as it may be deemed fit and proper to the facts and circumstances of this case.” Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 43/47 11. On perusal of the prayer made by the petitioners in C.W.J.C. No. 13312 of 2021, it thus appears that the legality of the notification dated 26.06.2021 was directly in issue for determination by the Court. Accordingly, this Court, upon adjudication, rendered a judgment in C.W.J.C. No. 13312 of 2021 dated 18.04.2022 finding no wrong with the impugned notification dated 26.06.2021. 12. L.P.A. No. 275 of 2021 was also preferred challenging the judgment dated 18.04.2022, rendered in C.W.J.C. No. 13312 of 2021 by the petitioners therein, which was also dismissed thereby upholding the judgment dated 18.04.2022, passed by learned Single Judge in C.W.J.C. No. 13312 of 2021. 13. Perusal of the prayers made in C.W.J.C. No. 12481 of 2021 by the petitioners therein as extracted herein above, though does not distinctly indicate that the notification dated 26.06.2021 was directly in issue, but when the said writ petition came up for adjudication before the Court on 20.06.2022, learned Senior Counsel appearing for the petitioners therein had fairly submitted before the Court that the matter stands adjudicated by this Court conclusively in C.W.J.C. No. Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 44/47 13312 of 2021 vide order dated 18.04.2022. For ready reference, order dated 20.06.2022, passed in C.W.J.C. No. 12481 of 2021 is quoted herein below:- “The case is being taken up from defect side. Learned counsel for the petitioners is directed to submit the original petition along with attested affidavits and also remove all the defects pointed out by the Registry within two weeks from today. Learned senior counsel has fairly states that the matter stands adjudicated by this Court conclusively in C.W.J.C. No. 13312 of 2021 decided by this Court on 18th April, 2022, wherein this Court has observed as under:- “8. Thus, no vested right can be said to have been created in favour of candidates who qualified the exam. The advertisement although mentions various posts against various subjects, it is apparent from the reply filed by the State Government as well as from the impugned order that the State Government has not intended to fill up post under the advertisement. In fact, the posts are to be filled by the Panchayats and Zila Parishad under the Rules framed thereto. Each Employing Unit is required to fill up the posts for its Panchayat/Zila Parishad. 9. In view thereof, the State Government action of declaring the examination conducted by the Bihar School Examination Board as a qualifying examination treating it as Secondary Teacher Eligibility Test (S.T.E.T.) qualified candidates, cannot be said to be illegal or unjustified. Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 45/47 Candidates who have passed the Secondary Teacher Eligibility Test (S.T.E.T.), 2019 Patna High Court CWJC No.13312 of 2021 dt.18-04- 2022 8/11 examination and secured the minimum qualifying marks will all have been treated as qualified to participate in the selection process. However, the selection process for each unit has to be done individually and those who are found themselves in the merit according to the rules, would get a chance of appointment in their respective units. Thus, in other words, the State Government has de-centralized the appointment procedure for teachers in various Districts, Panchayats and Zila Parishad. The general advertisement thus has not been acted upon. 10. In the opinion of this Court, the aforesaid action of the State Government lies in the exclusive executive domain and such administrative decisions would not be a subject matter of judicial review. 13. It is a case where the State Government has given go by to the entire advertisement and has decided not to fill up the posts under the said advertisement. It is also not a case where any discrimination has been done Patna High Court CWJC No.13312 of 2021 dt.18-04-2022 11/11 vis-a-vis the petitioner in the circumstances, no interference is warranted.” Keeping in view of the above, the present writ petition is disposed of in aforesaid terms, as prayed.” 14. In view of the above, I find that the notification Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 46/47 dated 26.06.2021 which has been challenged in the present two writ petitions already stands adjudicated by this Court in the writ petitions and LPA mentioned above. 15. Learned counsel for the petitioners have submitted that neither the petitioners of above mentioned two writ petitions nor the present petitioners have assailed the judgments dated 18.04.2022 and 20.06.2022, rendered by this Court in C.W.J.C. No. 13312 of 2021 and C.W.J.C. No. 12481 of 2021, respectively, nor any further steps were taken by the petitioners of either of the above mentioned writ petitions or the present petitioners to challenge the decision dated 27.09.2023, rendered in the L.P.A. No. 257 of 2022, upholding the judgment dated 18.04.2022, passed by the learned Single Judge in C.W.J.C. No. 13312 of 2021. 16. It has also been submitted by learned counsel for the petitioners that the petitioners of both the present writ petitions are similarly situated with the petitioners of the earlier two writ petitions, i.e., C.W.J.C. No. 13312 of 2021 and C.W.J.C. No. 12481 of 2021. 17. Since the notification dated 26.06.2021, issued by Deputy Secretary, Education Department, Government of Bihar impugned in the present two writ petitions was earlier Patna High Court CWJC No.13488 of 2023(7) dt.01-05-2025 47/47 challenged by some other persons similarly situated like that of the petitioners in the present two writ petitions and on adjudication of the same, a co-ordinate Bench of this Court in the writ petitions mentioned above has rendered an elaborate judgments finding no fault with the notification impugned in the present writ petitions dated 26.06.2021, I am of the view that this Court cannot enter into a fresh adjudication on the legality of the same notification dated 26.06.2021, which has already been adjudicated by a co-ordinate Bench of this Court in the writ petitions mentioned above taking any contrary view other than the view taken earlier by a co-ordinate Bench of this Court. That apart, the decision rendered in C.W.J.C. No. 13312 of 2021 has also been affirmed by the LPA Court as pointed out in the counter affidavit filed by respondent nos. 1 and 2 in C.W.J.C. No. 18747 of 2024. 18. In that view of the matter, the present writ petitions stand dismissed. Amrendra/- (Nani Tagia, J) U
