Ms. Deepali Verma, AAG, Haryana. **** SANDEEP MOUDGIL, J (ORAL) This petition has been filed under Article 226 of the Constitution of India for issuance of writ in the nature of Mandamus or any other appropriate direction to the respondents to protect the life and liberty of the petitioner from the respondents no. 3 to 5 as the petitioner is being unnecessarily harassed by respondents no. 3 to 5 in complaint case number 1, DD entry no. 055, dated 07.05.2025 under Sections 18A, 17, 17A, 17B of the Drugs and Cosmetics Act, 1940 registered at Police Station City Fatehabad, Fatehabad, Haryana by making threatening calls to arrest the petitioner despite the fact that the petitioner has joined investigation and cooperated in the investigation by providing all the relevant information as asked and required by the respondents no. 3 to 5 as per the Anuradha 2025.07.30 23:06 I agree to specified portions of this document
CRWP-8128-2025 (O&M) 2 anticipatory bail order dated 23.05.2025 (Annexure P-3) passed by this Hon'ble High Court, moreover, the malafide intention of respondents no. 3 to 5 is very much clear from the order dated 01.07.2025 (Annexure P-5) passed by the learned Chief Judicial Magistrate, Jind which specifically mentioned that the alleged main accused (Himanshu) was kept in illegal custody by respondent no. 4 (Drugs Control Officer, Jind-I). 2. At the outset, learned counsel for the petitioner submits that he will be satisfied, in case a direction is issued to respondent No.2-State Drug Controller, SCO-94, Sector-5, Panchkula, Haryana to decide the representation dated 16.7.2025 (Annexure P-6) within a time bound manner. 3. Without adverting to the merits of the case, the respondent No.2- State Drug Controller, SCO-94, Sector-5, Panchkula, Haryana is directed to consider and decide the representation dated 16.7.2025 (Annexure P-6), after providing opportunity of hearing to the parties, by passing a speaking order in accordance with law within a period of two weeks from the date of receipt of certified copy of this order. 4. A copy of order so passed be supplied to the petitioner within seven days thereafter. 5. Petition stands disposed of in the aforesaid terms.
