The petitioner approached the District Authorities to include the village of the petitioner namely Parsa Jhugiya into the Gram Panchayat Ama Pratham. 2. When the representation in this regard was submitted by the petitioner before the Respondent No. 5 namely Block Development Officer, Saltowa District Gopalpur on 20.06.2025, on the same date an order was passed on the aforesaid representation by him address to the District Magistrate, Basti/ Respondent No. 3 stating therein that decision in this regard could only be made by the State- Government. 3. It is argued that pursuant to the aforesaid, fresh representation has been made by the petitioner along-with other villagers before the Respondent No. 3/ District Magistrate, Basti on 03.06.2025, copy of which is send by the registered post to the Respondent No. 3 on 30.06.2025. Since no decision has been taken, the petitioner has preferred the present writ petition. 4. On the other hand, it is argued by the learned Standing Counsel that as per the letter dated 20.06.2025 written by the Respondent No. 5 to the Respondent No. 3, it is only the State Government who will take a decision in the matter. It is further argued that no representation has been made by the counsel for the petitioner raising his grievances before the State-Government. Hence, no relief could be granted to the petitioner insofar as the present writ petition is concerned. 5. At this point of time, a prayer has been made by the counsel for the petitioner to dismiss the present writ petition as not pressed with liberty to the petitioner to approach the State-Government. 6. Prayer is allowed. 7. Accordingly, the writ petition is dismissed as not pressed with liberty as prayed.
