The present writ petition has been filed challenging the First Information Report dated 15.07.2024 registering Case Crime No. 0245 of 2025, under Sections 281 and 106, of Bhartiya Nyaya Sanhita, 2023, Police Station-Sector-58, District-NOIDA. It has been argued by the counsel for the petitioner that there is no evidence to arrest the petitioner, but still the concerned police is attempting to arrest the petitioner. The A.G.A., on the basis of her instructions, states that the vehicle of the petitioner was found to be involved in the incident in a C.C.T.V. footage. Be that as it may, no purpose would be served to keep the petition pending. The writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 15.07.2024 registering Case Crime No. 0245 of 2025, under Sections 281 and 106, of Bhartiya Nyaya Sanhita, 2023, Police Station-Sector-58, District-NOIDA till submission of police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
