The case of the petitioner is that she purchased the eastern portion of Plot No.21, measuring 6,000 sq. ft., under a registered sale deed and has been in peaceful possession and enjoyment thereof. The western portion of the said plot was purchased by the father of the petitioner's co-sister, who subsequently settled the same in favour of the petitioner's co-sister. Both have been in uninterrupted possession and enjoyment of their respective properties. During the period when the petitioner was residing in the United States of America from 21.11.2021 to 11.05.2023, she, upon obtaining an online Encumbrance Certificate, came to know that a fraudulent General Power of Attorney had been registered in favour of the sixth respondent by impersonating the petitioner and her co-sister using fabricated identity documents. The petitioner thereafter lodged a police complaint and submitted a representation under Section 77-A of the Registration Act, 1908, before the District Registrar seeking cancellation of the fraudulent document. As no effective action was taken either on the police complaint or on the representation, the petitioner approached this Court seeking appropriate reliefs. __________ Page4 of 8 https://www.mhc.tn.gov.in/judis WP No. 16816 of 2025 3. The learned counsel appearing for the sixth respondent submitted that the sixth respondent himself intended to cancel the impugned Power of Attorney and had already filed W.P.(MD) No.8522 of 2025 before the Madurai Bench of this Court. By order dated 27.03.2025, the Madurai Bench directed the registering authorities to register the deed of cancellation relating to Document No.332 of 2022. 4. The learned Government Counsel appearing for the respondents 1 and 2 submitted that, if a deed of cancellation is presented, the same would be registered in accordance with law. 5. This Court has carefully considered the rival submissions and the materials placed on record. It is evident that immediately after the petitioner raised the issue of fraud, the sixth respondent himself approached the Madurai Bench and obtained appropriate directions for registration of the cancellation deed. The records disclose that the impugned General Power of Attorney had been registered by impersonating the petitioner through fabricated identity documents. The registering authority failed to exercise due diligence in verifying the identity of the executants before registering the document. __________ Page5 of 8 https://www.mhc.tn.gov.in/judis WP No. 16816 of 2025 6. In the above circumstances, this Court is satisfied that the General Power of Attorney dated 25.01.2022, registered as Document No.332 of 2022 on the file of the second respondent, is a fraudulent and invalid document, having been brought into existence by impersonation and fabrication of identity records. Consequently, the said document is liable to be cancelled. Accordingly, it is cancelled. The registration of the said General Power of Attorney shall stand cancelled. 7.
