This appeal is filed by the plaintiff, assailing the judgment and decree dated 12.12.2013 in O.S.No.462/2012 on the file of Senior Civil Judge and JMFC at Devanahalli, allowing the application filed by the defendant therein under Order VII Rule 11 (a) and (d) read with Section 151 of the Code of Civil Procedure, 1908. 3. Learned counsel for the respondent submitted that a settlement has been arrived at between the appellant and the respondent and as such, the Relinquishment Deed dated 12.11.2025 has been executed by the appellant - 3 - HC-KAR NC: 2025:KHC:51472 RFA No. 361 of 2014 herein in favour of the respondent. The memo is filed along with the copy of the Relinquishment Deed dated 12.11.2025. 4. In that view of the matter, there is no interference called for insofar as the appeal that is preferred by the plaintiff in view of the execution of the aforementioned Relinquishment Deed.
