3 CONCILIATION ORDER
This criminal revision petition is filed by the accused in C.C.No.3714/2016, assailing the judgment dated 08.11.2019 passed by the XIX Additional Chief Metropolitan Magistrate, Bengaluru City (for short, 'the trial Court'), and the judgment dated 07.10.2023 passed in Crl.A.No.2510/2019 by the LXVI Additional City Civil and Sessions Judge, Bengaluru City (for short, 'the appellate Court').

The trial Court, on a complaint filed by the respondent, convicted the petitioner for the offence punishable under Section 138 of the Negotiable Instruments Act and imposed a fine of Rs.4,00,000/-. The appeal preferred by the petitioner before the appellate Court came to be dismissed, thereby confirming the order of conviction and sentence passed by the trial Court.
3. The present petition has been referred to the Lokadalat. Both the parties, who are present before the Lokadalat, have agreed to settle the dispute on the terms recorded as below.
4. The cheque amount involved is Rs.2,00,000/-. The trial Court imposed fine of Rs.4,00,000/-, out of which Rs.3,90,000/- was
directed to be paid to the complainant. Aggrieved by the same, the
4 accused preferred an appeal, which came to be dismissed by the appellate Court.
5. The petitioner-accused agreed to pay a sum of Rs.2,40,000/- in full and final settlement, as against the fine of Rs.4,00,000/- imposed by the trial Court. The respondent-complainant has agreed to receive Rs.2,40,000/- towards full and final settlement of the claim.
6. It is submitted that a sum of Rs.2,00,000/- has been deposited before the trial Court, out of which Rs.1,00,000/- has already been withdrawn by the complainant-respondent herein. The complainant-respondent is at liberty to withdraw the remaining amount of Rs.1,00,000/- lying in deposit before the trial Court. Further, the petitioner has paid a sum of Rs.25,000/- in cash today, which has been received and duly acknowledged by the respondent. The petitioner has agreed to pay the remaining amount of Rs.15,000/- by way of GPay/UPI during the course of the day, which has been accepted by the respondent.
7. In view of the above settlement, the orders passed by the trial Court as well as the appellate Court stand modified accordingly. A
5 joint memo to the above effect is filed and the same is taken on record.
8. Accordingly, the dispute stands settled and the petition is
disposed of.
