ORAL ORDER
Heard Sri.Rithish D. Naik, learned counsel on behalf of Ms.Renuka Devi. A.S., learned counsel for petitioner.
2. Wife's petition under Section 24 CPC with the following prayer:
"WHEREFORE, it is most respectfully prayed that, this Hon'ble Court may pleased to allow the petitioner: To transfer M.C.No.127/2024 pending before Family Court, Kodagu-Madikeri to Principal Family Judge, Bangalore."
3. Facts in a nutshell which are utmost necessary for disposal of the present petition are as under:
Petitioner-wife has filed a petition in M.C.No.6275/2024 at Bengaluru whereas respondent- husband has filed a petition under Section 13 of the Hindu Marriage Act for divorce before the Family Court at Madikeri, Kodagu District in M.C.No.127/2024. Wife has

also filed petition for maintenance in Crl.Misc.No.861/2024 at Bengaluru. Wife is now seeking the transfer of the divorce petition from Madikeri to Bengaluru on the ground of geographical distance and financial incapacity. It is also contended that the maintenance amount is also not paid by the husband.
4. This Court did not deem it fit to issue notice to the respondent in the case on hand on account of the issue to be thrashed out in the present petition.
5. Having heard the counsel for petitioner, geographical distance and financial incapacity are no longer valid parameters for transfer of divorce case from Madikeri to Bengaluru Family Court in view of the video conferencing facility.
6. Wife can effectively participate in the divorce case at Madikeri through video conferencing facility. If the wife makes such an application before the Court at Madikeri,

learned trial Judge shall permit the wife to appear through video conferencing.
With that direction, following:
ORDER Petition is dismissed.
