The prayer in this petition under Section 528 BNSS is for setting aside/quashing of the order dated 26.08.2025 (Annexure P-1) passed by the Special Judge, CBI, SAS Nagar (Mohali), Punjab in CRM No.674 of 2025 titled as ‘Aman Garg versus CBI and another’, in RC No.219-2019-E-002 dated 27.02.2019 under Section 120-B read with Sections 420, 467, 468 and 471 IPC, Police Station CBI-EO-1, New Delhi. 2. The learned counsel for the petitioner contends that in furtherance of the aforesaid order, the passport was released to respondent No.1-Aman Garg, pursuant to which he has travelled abroad, come back and surrendered the passport once again. The learned counsels for the respondents No.1 and 2, on the other hand, contend that the present petition is now an exercise in futility as the respondent No.1 has already travelled abroad, came back and re- surrendered his passport. 4. I have heard the learned counsel for the parties. 5. As the order dated 26.08.2025 (Annexure P-1) has already been complied with inasmuch as the respondent No.1 has travelled aborad, came back and re-surrendered his passport, the present petition is effectively rendered infructuous and the same is disposed of as such. 6. Needless to say that on a later occasion, if a similar situation arises, the petitioner would be at liberty to challenge the order passed at that stage. 7. The pending application(s), if any, shall stand disposed of accordingly.
