Petitioner is serving as JBT in the respondent- Education Department. His grievance is to the office order dated 15.03.2024, whereby, he had been transferred from GPS Khajiyar (Sataun) District Sirmour to GPS Bounch, District Sirmour, H.P.

Learned counsel for the petitioner submitted that petitioner had joined at GPS Khajiyar on 06.08.2022; He had not completed his normal stay at the time of passing of the impugned order. It was submitted that petitioner had been

- 2 - transferred on the basis of a D.O. note.
Considering these submissions, operation of impugned order was stayed on 20.03.2024.

It is an admitted position that by now, petitioner has completed two years and nine months at the present place of posting, therefore, can be transferred.
Further, respondents in their reply have given the incumbency position of the petitioner. In terms of which, petitioner has been serving within a radius of 5 K.Ms from 17.12.2019, as such, he has completed six years in the vicinity of the same place.

In view of above, the writ petition to stand
disposed of. Interim order dated 20.03.2024 stands vacated. It shall be open for the respondents to transfer the petitioner in accordance with the applicable transfer policy.
Pending miscellaneous application(s), if any, also stand disposed of.
