Neutral Citation No. - 2025:AHC:133365 Court No. - 4 Case :- WRIT - A No. - 11166 of 2025 Petitioner :- Ajay Kumar Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Akhilesh Chandra Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the parties and perused the records. Petitioner is aggrieved by the order of punishment dated 17th September, 2019 passed by the disciplinary authority, whereby his five increments have been withheld for disciplinary proceeding has been drawn against him. Learned Standing Counsel submits that petitioner has an alternative efficacious remedy of statutory appeal which he ought to have exhausted in the first instance. At this stage, learned counsel for the petitioner states that appeal has now become time barred. Having heard learned counsel for the respective parties and having perused the records, I consider it appropriate to give one more opportunity to the petitioner to prefer statutory appeal under the U.P. Government Servant (Discipline and Appeal) Rules, 1999. Accordingly, it is hereby provided that in the event petitioner prefers statutory appeal before the appellate authority within a period of four weeks from today challenging the order passed by the disciplinary authority dated 17th September, 2019, the same shall be heard and disposed of on merits within a further period of two months instead of rejecting the same on the ground of delay. Needless to add, the order to be passed by the appellate authority, as directed herein above, shall be reasoned and speaking one.
